Reservations about SoundExchange's royalty offer to small webcasters seem to be growing louder, as several webcasters have already gone on record to reject the proposal. The San Jose Mercury News' siliconvalley.com quoted several longtime small webcasters who allege that the offer is geared to separate the tiny webcasters from the up-and-coming ones whose inevitable growth will subject them to much larger -- they would say prohibitive -- royalty rates.

REDUCED RATE TO SMALL WEBCASTERS

Music industry Internet proxy SoundExchange has begun sending formal performance royalty offers to "qualified small webcasters" that are essentially the same rates as had been in effect since 1998. While current rate negotiations between SoundExchange and Net broadcasters of all stripes are ongoing, this new offer purportedly will keep small webcasters afloat until a new rate is jointly agreed upon.

In 2006, private radio's advertising revenue increased 5.3% to $1.4 billion. That growth rate is slightly lower than the average of 5.7% over the last five years and much lower than the rate of 8.7% observed in 2005. The radio industry had a particularly prosperous year in 2005, posting its largest gain in advertising revenue since 1988.

BATTLE OVER PERFORMANCE ROYALTIES

Some of the NAB's worst fears about radio paying performance royalties to artists and labels were realized in the form of Rep. Howard Berman (D-CA). According to a report in Hollywood Reporter.com, the chairman of the House Intellectual Property Subcommittee began a hearing on the performance royalty issue by declaring that he wants to create a bill that would pay performers and the record labels a royalty for music played on terrestrial radio.

SIRIUS REPORTS 51% Q2 REVENUE JUMP

Sirius Satellite Radio second-quarter revenue jumped 51% to $226.4 million, as the company's net loss narrowed from $237.8 million to $134.1 million (17 to 9 cents'share) and the service's subscriber count rose 53% year-to-year to 7,142,538 at the end of the quarter. Sirius added 561,493 net subscribers, 431,650 of those from the OEM auto sales channel, and captures 62% of the satellite radio segment's market share. Ad revenue stood at $9.2 million.
