The National Hockey League may have ended its yearlong lockout with its players, but many problems remain. One of them includes making good some of its league sponsors. Sports analysts expect major league sponsors such as McDonalds Corp., Anheuser-Busch, DaimlerChrysler, MasterCard International, Southwest Airlines, and Nextel to perhaps renegotiate their deals, lowering some yearly license fees by 25 percent or even 50 percent for next season. At the top end, NHL sponsors pay anywhere from $8 million to $20 million per year as league sponsors. "Sponsors have taken some financial hits," says one media agency executive who buys sports programming. "They could get rebates of anywhere up to a half of their sponsorship fees."

GROKSTER: GET OVER IT

By now, everyone in the industry knows that the United States Supreme Court ruled earlier this week that file-sharing services could be held liable for copyright infringement by consumers using their services. This is big. It means that companies can no longer operate such services without assuming some liability for how they are used. Many in our industry are disappointed by the decision, concerned that holding the creators of technology liable for any one of a myriad of uses will discourage innovation. They point to examples like the development of the tape recorder, photocopier, VCR, and personal video recorder as prime examples of innovative technologies that have flourished because they were not held back by lawyers worried that among their uses were the unauthorized copying of copyrighted materials. As an entrepreneur that takes pleasure in watching new technologies devastate slow-moving mature marketplaces, I was originally supportive of these arguments. How could I think otherwise? Upon reflection, however, I have changed my mind. I think that the court was right in Grokster. I think that the decision is best for the continued growth and development of the interactive media and advertising industry.

A MESSAGE FOR THE SALES FOLKS

Once or twice in my publishing career, I've taken a moment to write from the perspective of a planner/buyer and let the sales people of our industry know what the agency folks are thinking. This topic inevitably gets the most responses on the Spin board (as well as some of the more heated ones) as some people think I can be a little tough, while others thank me for my honest approach. I've left the topic alone for a couple years now, but the new rush of entrepreneurial spirit is making me think it's time to re-address the topic in the light of 2005.

The basis of all communication and decision making is emotion. The challenge of radio is to evoke emotion without eye contact. Emotion activates memory and you want to be remembered. You want to be more then remembered. You want to tattoo your brand on their brains, but you want them to smile about it, enjoy it, and not feel used. As in all special relationships you must be patient. You reveal your total personality slowly over time.
